What is the legal definition of male gender?

In our state, there is a woman who is a transgender. She has legally changed her gender to a male. Now he is pregnant. I want to know what is the legal definition of a male and how can she legally change her gender with out having male parts?What is the legal definition of male gender?

Get diagnosed with Gender Identity Disorder.

Live for a minimum of one year as the gender you feel you are.

Petition a court for a legal name change. (easily done)

Take hormones.

Get referral letter for surgery.

Get ONE permanent, irreversible gender specific surgery (this could be a hysterectomy, a phalloplasty, OR just chest reconstruction from having female breasts to a male chest)

Petition court for a legal gender change based on letters from surgeon.

Chest surgery for female to males is still considered sexual reassignment surgery becuase you are operating on the female breasts which are gender specific.

Technically a legal gender change doesn't occur until the transperson has sexual reassignment surgery(SRS)--which doesn't happen with all of them. Often, especially with female to males the bottom surgery (SRS) is not part of the transition process, it's too costly, and the results are just not that great. So technically even though the person lives as male, the legal definition of that person is still female.
i don't know about legally, but technically gender is a construction of society, and sex is the biological construction.... so really male or female gender is societal norms that the gender identifies with....just so you know.

    If I am honest, the thoughts have crossed my mind, as I am more comfortable with my 'masculine' side. But the surgery wouldn't make me a fully functioning male, and many FTM don't have bottom surgery. Not to mention the family and friends issue. So, basically, I wish I had been born a guy, but I wouldn't go through surgery to change.

    Living in Canada, When and how can I change my gender on documents?

    I live in Ontario Canada and I am transgendered. I will be starting hormone therapy soon. I know that I can change my name at any given time once I fill out the papers and whatnot. BUT when is it time for me to change my gender from female to male?? Do I have to be living as male for a certain amount of time?     I know that my son (in BC) was able to change his name and the status on his drivers license within eight months of starting to take T. I believe it only took a doctors note for the Drivers licensing branch to issue a new ID for him.

    As I'm a straight person I know of 2 people in my life that have made the complete change over.....So they could ONLY make legal and on legal documents when all the processors were completed then and only then doctor /s will sign documents in your behalf; To be of Truth, stamped, and with hospital records backing completed transitions.

    As for your name change You can do this right now, as you need not one single operation to change anything. Good luck on your new journey through life and happiness.

    Not exactly an answer but the links may be of some use.



    Entirely as a guess I think there's a point where a specialist agrees that you are the new gender and have no intention to reverse the decision, I'm not sure if gender re-assignment surgery is a necessary pre-urequisite but suspect it is.



    FTMs have much lower visibility than MTFs so I can imagine it's a very difficult road needing to explain so many times that it can get boring, For that I don't envy you at all and for that I know it will make sure you are 100% sure of the decision.



    Best of luck, perhaps someone with personal experience can offer better advice.

    To answer your question, ';modern'; is just one of those terms (there is a specific terminology for this, but I'm no Shakespeare) that is used almost as a conjunction with binary opposition.     Those are just examples but in you question its more of a Womens Equal rights thing so with equal pay comes equal gender roles so a man no longer has to be the provider if he doesnt want too, he no longer has to do all the things to get in a girls pants or no longer has to be honorable. Girls can get pregnant at a young(early teens) age and every congratulate her.
    Wow, so what that's my opinion. Women have a choice to what they want to do and so do men. It's not our destiny or roles to be wives and mothers. Nor is it a man's responsibility to work and bring home the bacon. Most people don't even get married anymore. Obviously, these genders don't work and they will never work. Not all me want a stay at home wife and not all women want to be stuck at home all day with the kids. Marriage is about teamwork. There are a lot of stay-at home dads and there are a lot of married couples who don't have kids. So WTF are you talking about? Just because you see a nuclear family with a dad mom and 2.5 kids and the dad works while the mom stays home doesn't mean that they are happy.
    Its not the year but the times have changed things. It started when women had to go to work during WWII. When the men came back it was impossible to go back to how things were. Women had tasted the rewards and trials of making a pay check. Many other factors have come in to play as well but that was a big start to those things. You can go back further to women's suffrage. You could even go back to I think Hildagarde a middle ages christian lady who was some what of a Renaissance lady before the Renaissance happened. Of course do we really know the family structure from through out the ages or just the past few hundred years. I do believe there are roles we are more suited to as male or female but they are not limiting in the ways they have been in the past. It has not all been good changes but it can hardly be said it has been all bad changes either. I hold to a more traditional view but I value freedom. Women should be able to work if they so choose and if a guy doesn't like that then find a girl willing to stay home.

    I am 36 years old, so I know it's a little late to do this, but I have hated my name all my life. I will tell you that I am a female and my first name is Trey. What were my parents thinking?     That's a fabulous idea. I think your friends will have no problem with remembering your new name, as long as you don't mind them calling you ';trey'; sometimes. It will be like your original name is a nick-name for your new name.

    you're used to your name and it's part of your identity, your friends will still call you trey out of habit, so keep it as trey for a nickname, and ask a solicitor to legaly change your name. it will cost, but not a massive amount, and you may need to pay for a new credit card etc

    Go seek the assistance of a gender therapist. Or a therapist that specializes in Gender Identity Disorder.



    If you are really Transsexual, you and your therapist will work out a plan for gender transition.



    How long it will take will depend upon you and your therapist.How do i change my gender?
    errr you can do that when ever you want, but the only way is an expensive surgery. I'm not sure on the specifics though.
    look up doctors in your area that do gender reassignment surgeries. at least consult with them so you have an idea of the cost, complications, and recovery. i have heard it is very expensive, but i'm sure its worth it for those stuck in the wrong body.
    You have to undergo hormone therapy and alot of psychological evaluations before a doctor will even consider doing it.

    General semantics note: ';gender'; = your psyche. Can't change that, it's in your brain. ';Sex'; = physical form that brain inhabits. That's what you can change. Note that there's also social-sex role/presentation - that's how you're seen by other people. That you can also change, though this change may or may not corrospond directly to changes in one's physical sex.



    Basically, step one = research. Finding a good shrink who's worked with a lot of trans people in transition (transition = the process of changing from living as a man to living as a woman) is a good start. Support groups or social clubs or whatnot are also not a bad idea. Most people start out by changing their life incrimentally - changing their wardrobe, changing their hair, adopting a new name, etc.



    Generally speaking, as far as physical changes go, most people start with hormonal therapy. It has a more dramatic impact on your appearance than surgery (except possibly facial feminization surgery for some people), and costs far less. Most people get hormonal therapy by getting a letter from a shrink certifying that you're trans and basically emotionally stable, and you give that letter to an endocrinologist who writes the perscription for hormonal treatment.
    You can't change your gender- gender is what's between your ears, sex is what's between your legs. If you feel you are a woman inside, then that IS your gender... but if you were born male, then you need to change your sex characteristics. (Facial hair, other hair growth, breasts, voice, fat distribution, genitalia, etc.) This is done through hormone therapy and in many cases, surgery. (SRS, breast implants, tracheal shaves.)



    I suggest learning everything possible before you do ANYTHING. Read up on Gender Identity Disorder (Gender Dysphoria), transgender, transsexualism, etc. Find a therapist in your local area and maybe even some support groups. That'll really help.

    The best ways would those that would go mostly unnoticed. Try wearing women's underwear or getting an unpadded bra of a color that wouldn't be noticed (a muted tone like beige or white, for instance) of exactly your size so that no one would notice it under your clothes.



    You could also try women's jeans, which would go largely unnoticed, unless you got some that were designed to emphasize the hips and butt. There are also a wide variety of women's shirts that look enough like men's to not be noticed. Most people won't really be paying enough attention to even notice women's half-sleeve, three-quarters sleeve, or mostly sleevless shirts.



    One of the easiest ways is with shoes. People rarely look at a person's feet enough to notice if they are wearing women's or men's tennis shoes. However, if you walk around in platforms or high heals, everyone will notice. Although, shoes will be hard to find because women's shoes tend to be made for much smaller feet than those of the average man.



    Any of these options will allow you to try women's clothing without people noticing too much. This experience may also help you gain some insight into the lives of women, not so much because the clothes change who you are, but because the clothes will trick your mind into making you feel more feminine.



    Oh, and avoid carrying a purse, unless you want to get beaten up a lot. That is one thing that people will definitely notice.

    Yes I did.



    For the most part in the USA you need to FULLY transition, that means everything including sex reassignment surgery. By the way legal sex in the USA is determined by your birth certificate. After treatment transsexual people can change they birth certificates in 47 states. Only Ohio, Tennessee and Idaho do not allow changes, although those states will allow it sooner or later. The actual process of changing birth certificates varies slightly from state to state. In my state I petitioned the local Probate Court and asked to change the name and sex on my birth certificate. I showed them the notarized certification letter from my surgeon, paid the fee and less than two weeks later the court order arrived in my mail box. I then took the court order to the city hall of the place where I was born and was issued a brand new birth certificate (not an amended one). Beleieve it or not the legal fees were only $12.

    The top officials of the fundamentalist regime in Iran emphasize that it is the ';sacred'; responsibility of a woman to serve her husband and take care of the household. Ayatollah Ali Khamenei, the mullahs?';supreme leader,'; has declared that ';women檚 first job is to be a wife and mother.'; Khamenei dismissed the notion of women檚 equal participation in social life in July 1997 as ';negative, primitive and childish.';

    These blatantly prejudiced views shed light on how discriminatory legislation against women has been proposed, adopted, and enforced in Iran since 1979. All the existing laws in Iran, which deal with the rights of women, arise from the stereotyped presumption that men are endowed with the right to dominate women. A man can divorce his wife freely and has the right to retain custody of their children. Article 105 of the Civil Code stipulates: ';In the relationship between husband and wife, heading the family is characteristic of the husband.'; The Islamic Council of Guardians decreed that ';a woman does not have the right to leave her home without her husband檚 permission, even to attend her father檚 funeral.';



    Sale of Girl Children



    Girl children suffer the worst conditions in Iran today. According to the clerical regime檚 rules and regulations, a girl child can virtually be bought and sold with the consent of her male guardian. Article 1041 of the Civil Code provides that 楳arriage before puberty (nine full lunar years for girls) is prohibited. Marriage contracted before reaching puberty with the permission of the guardian is valid provided that the interests of the ward are duly observed.';



    It has become common practice to sell or force very young girls to marry much older husbands, giving rise to all sorts of social ills. Adineh magazine wrote in summer 1991: ';An 11-year-old girl was married off to a 27-year-old man. The father, who had seven daughters, received $300 for his consent. The morning after the marriage ceremonies, the girl was taken to hospital suffering from severe lacerations to her genitals.';



    The state-controlled daily, Ressalat, reported on December 15, 1991, that due to extreme poverty and the absence of the most basic facilities, the deprived people of northern Khorassan sell their young girls for as little as $33. The buyers, mostly from Gonabad, take the girls away and put them to work on farms and in workshops. In the impoverished province of Sistan-Baluchistan (southeastern Iran), girls eight - ten years old are sold by their drug-addicted parents for $4.



    Rape of Female Prisoners



    In a report on November 22, 1994, the United Nations Special Rapportuer on violence against women said ';the public stoning and lashing of women serves to institutionalize violence against women. The Special Rapportuer has received many allegations of such violent punishments being inflicted on women in the Islamic Republic of Iran.';



    According to a special ';religious decree'; issued by Ayatollah Khomeini, virgin women prisoners must be raped before execution to prevent their going to heaven. A Guard conducts the rape the night before their murder. The next day, the religious judge at the prison issues a marriage certificate and sends it to the victim檚 family, along with a box of sweets.



    Tens of thousands of women have been subjected to cruel torture and execution. One method is particularly revealing: the Revolutionary Guards fire a single bullet into the womb of women political prisoners, leaving them to bleed to death in a slow process of excruciating pain.



    In an eyewitness report, Amnesty International revealed how the small children of many young women in Evin Prison are viciously abused. Witness Helmut Szimkus, a German engineer, told Amnesty International they are kept ';because they are an asset to the prison authorities for gaining confessions.'; Szimkus, who was released after serving a lengthy sentence in an Iranian prison, said he witnessed several cases where Iranian children were tortured in the presence of their parents. ';One time these guys [torturers] raped a nine-year-old girl. The parents had to watch. The father shook and rattled so badly that he could no longer sign the espionage confession they put before him.';



    Rampant Prostitution



    The social environment imbedded in the misogynous views, laws and policies of the fundamentalist regime naturally spawns corruption, making it increasingly difficult for women to survive. Women bear the brunt of the economic difficulties and social barriers and restrictions. Large numbers of deprived women have been forced into prostitution or become addicted to drugs. Meanwhile, the clerical regime, touting Islam, claims to accord ';divine respect'; to women.



    ';It is appalling. Never has prostitution been so rampant. But everything is done behind the veil,'; Mahin, a 47-year old female Iranian jurist purged by the mullahs, told Helen Kami, the French journalist for Elle magazine who visited Iran in January 1997.     Gender cannot be changed, it is in built within the brain and cannot be re-wired, even if it could be, it would effectively destroy who a person is and create someone new.



    Anatomical sex can be altered through the administration of cross-sex hormones and various surgeries. For a female body as you suggest, this means administration of testosterone, and surgeries which may include some or all of - bilateral mastectomy, hysterectomy, phalloplasty, and scrotoplasty.



    But should only ever be undertaken by genuine transsexed persons, and those intersexed persons who feel the procedures necessary for them. It's a one way process so it's imperative that you're absolutely honest with yourself and sure it's right for you before you go ahead.

    I know someone who did this. You need to go to a doc or therapist that speciallizes in it.     Very simply,



    Males have seed pods that literally look like plant-testicles, dangling from the stems. These open up and make different colored flowers when mature.

    This sounds like homework too....but I'm bored, so...



    While granting a few more sexual freedoms, the sexual revolution of the 20th C also placed a heavier weight on the ';importance'; of conformity in the eyes of those with strict gender-based boundaries. In the eyes of the public, new and strange sexualities were emerging from the woodwork that, in reality, had been there all along. This placed a strain on those with traditional views, who in turn, pushed back. A movement was started, small and quiet, for nontraditional sexualities to gain acceptance in the public mind. The rift between the old school of thought and the new one brought to light uncomfortable tensions between the two that had been growing for years.



    Gay, lesbian, transsexual, trans gender, asexual, pan sexual, even things such as robo sexual or non-sexual. These things, as they gained media coverage, slowly became the topic of many would-be-concerned evangelist and politicians; and quickly afterward, became taboo among those with reputations or seats of power that could become shaken by the battle being fought. Civil rights groups began to campaign for equality, while others began fighting to discredit or quieten those blowing whistles. Court battle such as those in Massachusetts and California began to spread. Slowly, a couple states held that marriage was between two people and not just a man and woman.



    Women, began to gain more cultural freedoms and men, while still heavily influenced by decades old beliefs, were allowed more room for expression and sexually exploration. Groups and mind-frames such a ';emo'; and ';metrosexual'; became mainstream and quickly accepted. Gradually, men were allowed more freedom to be sensitive and women could become more aggressive.

    A Question for those with visible disabilities to ponder about disability and its effect on gender formation?

    In your opinion does having a visible disability hinder/destroy traditional gender roles or expand/reform them in both men and women? Those with disabilities and those non disabled people close to disability can answer this, but provide examples generally and from your life to back up your answer either way.



    For example in the past a boy with a moderate to severe physical disability (like me) was seen as at risk for being a homosexual simply because he couldn't play rough and do the things that ';normal'; boys would/could do. It's was assumed he would spend all his time in the company of older women in the house and that no girl would would want to be attracted to/seen relationally with a ';weak cripple.'; He eventually would be made into a sissy and be vulnerable to Communist threats. (A bunch of mostly bullshit in my opinion, but it was, at one time, seen as reasonable.) Then there are men who react to disability by displaying hyper masculinity and trying to ';get tough'; and ';beat it'; (more utter nonsense in my opinion as most disabilities are lifelong and if you can't accept some limitations and depend on other people for what is needed than it is just unnecessary struggle to appear ';inspirational'; and come out in the non disabled world on top as ';better'; than others who have the same disability or disabilities in general. I have also heard about women who have experienced the two fold passivity they were supposed to take upon themselves as women with a disability and wanted no part of it and thus ';reformed their gender expression'; to be more genderless or typically masculine because of their disability, among other factors.



    Personally, having a disability as a man is interesting to say the least for me with regard to gender because I don't (as with most men with disability I gather) fit into the typical male prototype physically or otherwise. I have a masculine identity (watching sports, bullshitting with guys about which celebrity women are hot etc), but I can say with all honesty that having a disability has made me ';more feminine'; than most guys because I have been around a lot of women from an earlier age simply because of surgeries, physical therapy, aunts, mother (because I can't physically work) add to that the fact that I'm naturally sensitive, introspective, and tuned to beauty (into poetry and such) and there is a feminine side/gender identity to me. I'm equally likely to comment specifically on a woman's clothes/makeup choice etc. (and then say she is hot and want to make out-- It's weird I know lol!) Generally, this gender queerness is a positive thing for me, although it be hard to balance. I have no homosexual inclination (proof of the above bullshit), but I can say from experience that a severe disability CAN and DOES feminize a man who is predisposed if he takes a certain nonchalant approach to being around women in his childhood (because that is where he will generally find himself if has medical problems/a long term disability.) The only hindrance my disability and experiences has on my gender is trying to convince ignorant women that I still find them attractive physically and sexually appealing even if I need to routinely let my hair down in a manner of speaking.



    So what do you think about this issue? How has having a disability reshaped expanded or hindered your own personal gender expression or does it even matter enough to warrant a chair at the table here? Was/is it a positive or negative experience in your opinion? Do you know men (and women) who could relate similar stories to mine...how has your personal experience been different?

    I think it does effect gender formation in people with developmental disabilities. My son went through the curious questioning stage far longer than his peers without disabilities.     Maybe their scared that their partners won't love them anymore.


    Just being honest im not sure i would want to stay with my husband if i found that out...I would feel like i didn't know who he is to began with ya know....and also in this society transexuality isn't excepted that much.
    Maybe because they think they'll be judged because they used to be a man/woman and essentially unhappy with what they were so maybe that's another reason for them not to mention it since they must hate the thought of who they used to be.


    It would only be dishonest if their partner asked them about it and they denied it in my opinion.


    Plus it's more important to love someone for who they are rather than what they are so it's really their own choice whether or not they mention it.
    Because they're worried that their partner will leave them and not love them anymore if they know.

    NO-ONE changes gender; it's not possible. Transsexual people correct their bodies, and their social presentation, to MATCH their gender.





    But I'll answer the meaning of the question, rather than the wording.





    First of all, I need to say that I am 'out' in my own community, I'm lesbian, and I'm in a long-term relationship, so I don't personally have to worry about this issue.


    However, (unlike some) I AM aware of my position of relative safety,and of privilege, and I've met, counselled, and patched-up enough trans women who are none of these things to understand that they don't have that privilege; and to realise that I don't have the right to tell them what they should do in this situation. I'm not going to be the one who is alone in a room, in a vulnerable state, hoping that my partner won't try to kill me because HE can't handle who I am.





    So I'll say this;


    Whether you're dating her or not, YOU don't have the ';right'; to know that a woman is, or is not, transsexual, and she is under NO obligation to tell you. That has nothing to do with 'dishonesty' or 'deceit' or 'shame'; it's quite simply none of your business UNLESS she chooses to tell you.


    If she loves you, cares for you, and trusts you, she WILL tell you; she will expose herself to the risk that you harbour some ignorant prejudices about trans people (Here's a thought; YOU don't feel the need to explain to your potential sex partners that you're NOT transsexual. Perhaps you should consider doing so, and see how it feels, and what reaction you get).


    As with anyone coming out to you, you should be HONOURED that they trust you enough to make themselves this vulnerable. You should be honoured that, in a world where trans people are often violently attacked 鈥?including by partners discovering they are trans, this person loves you, cares about you and trusts you enough to be told this.





    It is not reasonable or acceptable for someone to be upset at dating a trans person. There is nothing wrong with dating a trans person. There is no REASON to be upset about discovering your date or partner is trans.


    Nor, in a world that is grossly and violently transphobic, is it acceptable for you to expect every trans person to disclose the fact they are trans before dating them. Why is it relevant? You like them, you鈥檙e dating them, you enjoy being with them 鈥?why does there being trans change this?

    Sadly because the ones who think it's OK are immoral beings. In answer to your questions: yes, it is dishonest to the nth degree and I guess they must truly be self-loathing to hide what they are. Perhaps they can't help their gender problems, but foisting their transsexualism on normal people is cruel. If it wasn't such a big deal, then why do so many of them feel ';it's no one's business!'; or ';it's my personal history';? Yes it is, until you start infilterating our personal heterosexual world.





    Relationships are supposed to be built on trust and honesty. Not fantasy. ';I always felt like a girl, so by George: I was one! Nevermind the fact that my genetics and genitals (pre-op) say different! It's irrelevant!';





    Amputating you penis and replacing it with a tunnel and forcing your body to undergo an artifical puberty through hormones is a BIG DEAL. Sewing up your vagina and having it replaced with a tube of skin is also a BIG DEAL. There are a few cis-people who don't have a problem with transsexuals and would in fact be delighted to hear this revelation of honesty from their potential lover. Like-wise, a cis-gendered person would be inclined to view a transsexual in a better light if they were upfront about what they are. A transsexual will always be a transsexual. You can't erase that you attempted to change your sex. (';Attempted'; because the chromosomes cannot be altered, neither can the bones. Internal male organs cannot be replaced with female ones and vice versa. All that can be done is by nature artifical).





    If getting a sex-change is no big deal, then why do it in the first place? It's a HUGE deal. That's why people get angry when their potential lover tries to hide their transsexual status.





    As long as we have dishonest transsexuals, we can expect transphobia to run rampant and sadly violent attacks to increase. Thankfully, most transsexuals can be identified on sight.

    Questions like these are always based in transphobia. It's clear from your question you do not respect the gender identity of transsexual people. In this case a transsexual woman.





    A transsexual woman is a WOMAN who was born into a male body, but she was never a man. Her brain has always been female.





    A transsexual man is a MAN who was born into a female body, but he was never a woman. His brain has always been male.








    That's what transsexualism is, a brain-body mismatch. It is a rare birth condition and as such no choice is involved.     The problem is most of society is waaaayyyyy behind the science on this matter. They want to believe all the old stereotypes they've learned about transsexual people. And one of those is that we ';deceive'; people. As explained above that isn't happening at all. But that doesn't stop many people from acting on their transphobia by assaulting or killing us. The real question here is why can't people learn the truth? Why are they so stubborn about scientific truth?





    In an effort to avoid getting killed transsexual people have come up with various strategies to cope with the dangerous, ignorant world we live in.





    Many non-transsexual people like to advocate immediate disclosure of our private medical information. What they don't realize is this harkens back to Nazi Germany. Are they going to want us to go back to wearing pink triangles to (transsexual people were thought to be gay)?

    Immediate disclosure almost inevitably results in rejection. That shouldn't be surprising considering how ignorant our society is when it comes to transsexualism.





    The next strategy is to wait until the person gets to know you a little bit. This way the non-transsexual person gets to learn that the negative stereotypes they learned growing up are wrong. Then it's a matter of will the person accept the truth that's in front of them or hold tight to the stereotypes and reject the truth. Sadly many people do the latter.





    The next strategy is similar to the last: Disclose before having an intimate encounter. Sadly, again many people reject us.





    The final strategy, which I do not advocate, is never disclosing. This option is often called ';stealth';. The problem is in today's information age the chances of remaining stealth forever, without becoming discovered, are quite small. It's like living in a very tight closet.








    So now if you've read this far you can see the dilemma faced by transsexual people. Not as easy as you thought is it? Most people take a path somewhere in the middle. And it's has NOTHING to do with deception. It is about balancing safety and the ability to meet new people. As noted by others hundreds of us have been killed over the last 50 years.
